Public Offer and Digital Goods Purchase Terms

1. Terms
VoxAudio is an online service providing users with access to digital audiobooks, preview fragments, a personal library, a protected audio player, subscriptions and gift certificates.
User means an individual who registers on VoxAudio or uses the website to browse the catalog, purchase digital access, a subscription or a gift certificate.
Digital goods / digital access means access to an audiobook, chapter, subscription, personal library, protected audio player or other digital content provided through VoxAudio without delivery of a physical medium.
2. Subject of the offer
VoxAudio provides the user with the possibility to purchase digital access to audiobooks, chapters, subscriptions to the available catalog and gift certificates.
No physical delivery is performed. Access is provided electronically through the user account after successful payment confirmation by the payment provider.
3. Formation of the agreement
The publication of this document on the website constitutes a public offer. The user accepts the offer by registering, placing an order, ticking the required consent checkbox and/or paying for digital goods.
Before payment, the user must read this offer, digital goods purchase terms, refund terms and the personal data processing policy.
4. Digital goods purchase terms
By ticking the consent checkbox before payment, the user confirms that:
- they understand that they are purchasing digital goods / digital access, not a physical product;
- they agree that digital access may be provided after successful payment confirmation;
- they understand that access to the full audiobook, chapters or subscription may be provided immediately after payment;
- they agree not to copy, distribute, transfer, publish or make publicly available VoxAudio audio files, access links, certificate codes or other materials;
- they understand that a gift certificate is a digital code and may be redeemed only once;
- they understand that a subscription provides access for the selected limited period.
5. Prices and payment
Prices for digital goods, subscriptions and gift certificates are shown on the website at the time of ordering. Payment is made through connected payment providers.
Access is provided after successful payment confirmation. In some cases payment confirmation may require additional processing time by the payment provider.
6. Subscription
A subscription provides the user with access to digital content available on the website for the period selected at the time of payment. After the subscription period expires, access to subscription-based materials may be terminated.
VoxAudio may change the catalog, add new works, update or remove technical materials, provided this does not violate the user’s already granted paid access to separately purchased books.
7. Gift certificates
A gift certificate is a digital code granting the right to receive a specified book, subscription or other digital access.
A certificate may be redeemed once. After redemption, access is assigned to the account of the user who redeemed the code. The person who purchased or received the certificate is responsible for transferring the code to third parties.
8. Refunds
A refund may be possible if digital access was not provided due to a technical error, payment was charged incorrectly, or the user did not receive the paid access and the issue was not resolved by VoxAudio support within a reasonable time.
Refunds may be limited or unavailable after the user has been granted access to the full digital content and has started using the paid digital access, except where mandatory provisions of Russian law provide otherwise.
To request a refund, the user should contact VoxAudio support and provide the account email, payment date, payment method, payment amount and issue description.
Refund timing and method depend on the payment provider and the payment method used.
9. Usage restrictions
The user is prohibited from:
- copying, downloading, distributing or publicly posting audio files unless such option is expressly provided by the service;
- bypassing technical access protection measures;
- transferring login, password, access links or certificate codes to third parties;
- using VoxAudio content for commercial purposes without written consent of the rights holder;
- performing actions that violate Russian law or third-party rights.
10. Personal data
When registering, purchasing, redeeming a certificate and using VoxAudio, the service processes the user’s personal data to the extent necessary for registration, contract performance, access provision, payment processing, purchase accounting and communication with the user.
Consent to personal data processing is obtained separately from this offer and other documents where such consent is required by Russian law.
11. Technical restrictions
VoxAudio takes reasonable measures to protect digital content: limitation of direct downloads, protected player, temporary links, access checks and audio request logging. The technical ability to play digital content does not mean permission to copy or distribute it.
12. Liability
VoxAudio is not responsible for access issues caused by the user’s device, unstable internet connection, blocking, actions of payment providers, hosting providers, telecom operators or other circumstances beyond VoxAudio’s reasonable control.
13. Governing law
The relations between the parties are governed by the law of the Russian Federation. Disputes shall be resolved through negotiations, and if no agreement is reached, in accordance with the procedure established by Russian law.
14. Changes to the terms
VoxAudio may amend this offer. The new version becomes effective from the moment of publication on the website unless otherwise specified. Paid orders are governed by the terms effective at the time of payment unless otherwise required by law.
